These Terms are the agreement between you and Bonus Bite for using our site and email service. The short version: we point you toward birthday deals, but the restaurants run those deals, so always confirm before you go.

These Terms of Service ("Terms") are a binding agreement between you and Bonus Bite ("Bonus Bite," "we," "us," or "our") governing your use of the website at bonusbite.com and our related email and birthday-deal service (together, the "Service"). By using the Service or joining our list, you agree to these Terms. If you do not agree, please do not use the Service.

Who may use the Service

You must be at least 13 years old, or the minimum age where you live, to use the Service. By using it, you confirm that you meet this requirement and that the information you give us is accurate.

What Bonus Bite is, and is not

Bonus Bite is an independent information and discovery service. We collect, organize, and share information about birthday-related deals, promotions, and offers at restaurants and other businesses, with a focus on the Chicago area.

We do not provide the deals. The offers described on the Service are created, controlled, changed, and honored solely by the third-party businesses that offer them. Bonus Bite is not affiliated with, endorsed by, or acting on behalf of those businesses unless we clearly say so. We do not guarantee that any deal is available, accurate, current, or will be honored.

No guarantee of accuracy

Deals and rewards programs change often and at each business's sole discretion. While we work to keep information useful and to show how recently a deal was confirmed, we make no promise that any listing is complete, accurate, or up to date. Any confirmation counts, success rates, dates, or "verified" labels are there to help you decide and are not a guarantee. Always confirm a deal's current terms directly with the business before relying on it.

Your responsibilities

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• submit false, misleading, or fraudulent information, including about deals;
• interfere with or disrupt the Service, or try to gain unauthorized access to it;
• scrape, harvest, or collect data from the Service except as we permit in writing;
• use the Service to send spam or to harass others; or
• infringe the rights of Bonus Bite or anyone else.

User submissions

The Service may let you submit content, such as reports on whether a deal worked, comments, or other information ("Submissions"). You are responsible for your Submissions and confirm you have the right to provide them. You grant Bonus Bite a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, and display your Submissions in connection with operating and promoting the Service. We may, but do not have to, review, moderate, or remove Submissions at our discretion.

Intellectual property

The Service, including its design, text, graphics, logos, the cherry mark, and compiled listings, is owned by Bonus Bite or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial use. You may not copy, reproduce, distribute, or create derivative works from the Service without our written permission, except as the law allows.

Email and marketing

By joining our list, you consent to receive emails from us, including launch news and birthday-related offers. You can unsubscribe anytime using the link in any email. We follow applicable anti-spam laws, including the U.S. CAN-SPAM Act.

Third-party businesses and links

The Service references and links to third-party businesses and websites we do not control. Your dealings with any third party, including any purchase, reservation, or redemption of a deal, are solely between you and that third party. Bonus Bite is not responsible or liable for the products, services, conduct, pricing, or policies of any third party.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEAL OR INFORMATION IS ACCURATE OR WILL BE HONORED. Some places do not allow certain warranty exclusions, so parts of this may not apply to you.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BONUS BITE AND ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY DEAL, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some places do not allow certain limitations, so parts of this may not apply to you.

Indemnification

You agree to indemnify and hold harmless Bonus Bite and its owners, employees, and partners from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your Submissions, or your violation of these Terms or any law or third-party right.

Termination

We may suspend or end your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Service and unsubscribe at any time.

Changes to the Service and these Terms

We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we do, we will change the "Last updated" date, and we will communicate material changes as the law requires. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute arising from the Service will be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction, unless applicable law provides otherwise.

Severability and entire agreement

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Bonus Bite about the Service.
